New York's colossal $124 billion Medicaid program is under the microscope! Dr. Mehmet Oz, the new Medicaid czar, is launching a significant investigation into the Empire State's healthcare giant, alleging it's riddled with waste, fraud, and abuse. This move is set to put Governor Kathy Hochul's administration under intense scrutiny.
In a direct letter to Governor Hochul, Dr. Oz, who leads the US Centers for Medicare and Medicaid Services (CMS), has posed a comprehensive set of 50 questions. These inquiries are designed to thoroughly examine the strategies and actions taken by the Governor and her team to manage costs, detect, and prevent fraudulent activities within the program. Dr. Oz stated, "I am formally requesting detailed information regarding program integrity and provider screening and enrollment oversight within New York’s Medicaid program. This request is necessary to ensure public confidence and protect beneficiaries in your state’s Medicaid program."
What exactly is Medicaid? Simply put, it's a vital public health insurance program designed to assist those in need. Its financial burden is shared across the federal, state, and local government levels.
Dr. Oz highlighted a stark financial reality: "The data is clear. New York far outspends other states on its Medicaid program on a statewide and per beneficiary basis." This concern was echoed in the letter sent to key New York health officials, including State Health Commissioner Dr. James McDonald, State Medicaid Director Amir Bassiri, and acting Medicaid Inspector General Frank Walsh Jr.
Here's a staggering statistic: New York's average spending per Medicaid beneficiary stands at a hefty $12,528, which is a remarkable 36% higher than the national average. Dr. Oz further elaborated, "New York’s average Medicaid spending per resident was the highest in the country — nearly 80% higher than the national average."
Why such a significant difference? Dr. Oz suggests it's a multifaceted issue, a combination of "more New Yorkers enrolled in Medicaid relative to the state’s population, potential fraud, expansive benefit structures, and excessive provider payment levels within New York’s program compared with most other states."
Currently, over 6.8 million New Yorkers, representing 34% of the state's population, are covered by Medicaid. One of the primary drivers of this program's rapid expansion, according to Dr. Oz, is the growing need for home care services for elderly New Yorkers, including in-home care, adult day care, and personal care programs.
But here's where it gets controversial... Dr. Oz also pointed to alarming instances of criminal fraud that have already come to light. The Justice Department has uncovered schemes where individuals defrauded the state's Medicaid home care program out of millions. For example, two individuals in Brooklyn pleaded guilty to defrauding the program of a staggering $68 million by paying kickbacks for services that were never rendered at three of their businesses. In another disturbing case, 10 defendants were arrested for a home health aide fraud scheme, where Medicaid was billed for services that were never provided.
The Post has also recently exposed how the state may have lost millions in taxpayer money to scammers through the Consumer Directed Personal Assistance Program (CDPAP). Furthermore, it's estimated that up to $400 million annually is spent on Social Adult Day Care centers, which often provide services that are already available at senior centers.
Dr. Oz emphasized the gravity of these findings: "These cases expose ongoing program integrity vulnerabilities within the New York State Medicaid program and home and community-based service delivery system that warrant structural program-integrity measures given the scale of such services."
And this is the part most people miss... The investigation also revealed a concerning 121% increase in spending on non-medical transportation services in the last three months of data analyzed. Dr. Oz expressed worry that some providers are billing Medicaid for both adult day care and transportation services. This practice could potentially facilitate "coordinated fraud" through tactics like recruitment schemes, phantom rides, inflated mileage claims, and billing for transportation to adult day care sessions that never actually happened.
Additionally, Dr. Oz noted that spending on mental health and psychotherapy services also appears to be unusually high, warranting further investigation.
It's worth noting that Dr. Oz has initiated similar probes in California and Minnesota, indicating a broader pattern of concern regarding Medicaid program integrity across different states.
Governor Hochul, in a statement released on Tuesday, defended her administration's commitment to combating waste, fraud, and abuse. She highlighted efforts to reform the CDPAP, which she claims have already saved over $2 billion for taxpayers while safeguarding essential home care services. Her office stated, "New York will continue to work with the federal government to identify bad actors, just as we did when we partnered with the Justice Department on the successful investigation cited in this letter."
However, the Governor's office also pivoted, suggesting that the investigation might be politically motivated, stating, "But let’s be clear about the real goal for Donald Trump and Washington Republicans: eliminating programs that support our most vulnerable and ripping away healthcare from everyday New Yorkers."
